  1. Basic data from the Joint Operators Agreement.

The companies belonging to the PERSONALITY Group have jointly concluded a Joint Operators Agreement pursuant to Article 26. Regulations, in which they agree on rules for sharing the databases they create and use together. They also agreed that the organizational and security rules for the databases are determined by the company Personality, s.r.o. with registered office at Svätoplukovo námestie 1/B, Nitra 949 01, ID No. 44 549 733 (hereinafter referred to as “Company“), this Company also represents all joint controllers vis-à-vis the data subjects, shall be the point of contact for the persons concerned, cooperate with supervisory authorities and exercise other rights and obligations of the controller under the Regulation. Notwithstanding the existence of a Joint Operators Agreement, you may exercise your rights with any company in the PERSONALITY group, but the quickest way to do so is to contact the Company at the contact address above.

3. Information for different categories of data subjects and purposes of processing

Below we provide information for individual processing purposes and for individual data subjects. For more detailed information, please click on the link that applies to you.

Affected Persons: Affected Persons in this case are individuals who have contacted Personality Group electronically, by telephone, in person, by letter or otherwise in response to a specific advertisement or offer of employment or a position with a specific employer (hereinafter referred to as “Applicants“)

What data we process, on what legal basis, for what purpose and for how long.

Scope of Personal Data: If you are responding to a specific offer of employment or a job position made in any form or responding to an advertisement or information about a vacancy for a specific employer or the PERSONALITY Group for a specific employer (hereinafter referred to as the “Offer“).”), we process your personal data within the scope of the response form and the data requested in the offer, which are mainly name, surname, title, date of birth, address, email, telephone number, professional history, language skills, education, salary expectations, as well as the data contained in the CV, public profiles on the candidate’s personal networks and other documents that you have provided to us and the data contained in the records of interviews that you have completed with the PERSONALITY Group or with the prospective employer.

Purposes of processing:

  1. Identifying and recommending suitable candidates for the job, checking whether the candidates meet the requirements and needs of the particular employer and the process of recruiting an employee or worker for the job (hereinafter referred to as the “selection process”) as well as the preparation of an employment contract or other similar private law contract or agreement between the candidate and the prospective employer.

  2. Provision of applicants’ data to potential employers for the purposes of the selection process and the selection of employees or workers for a vacancy, as well as the preparation of an employment contract or other similar private law contract or agreement between the applicant and the prospective employer.

  3. Asserting, defending and proving legal claims of the PERSONALITY Group and employers related to the recruitment process of a job applicant or services provided by the PERSONALITY Group to employers.

  4. Archiving, scientific research or statistical purposes.

Legal basis

For the purposes of points 1 and 2 above, the legal basis for the processing of applicants’ personal data is Article 6 (1) (b) of the Regulation, i.e. the fact that the processing is
necessary for pre-contractual measures to be taken at the request of the data subject (pre-contractual relationship between the applicant, PERSONALITY and the potential employer).

For the purpose of point 3, the legal basis is Article 6 (1) f) of the Regulation, i.e. the existence of a legitimate interest of the PERSONALITY Group and/or the employer in asserting, defending and proving legal claims of the PERSONALITY Group and/or the employers related to the recruitment process of the job applicant or the services provided by the PERSONALITY Group to the employer.

For purpose 4, the legal basis in accordance with Article 6 (1) c) Regulation of the fulfilment of the legal obligation of the operator, resulting in particular from Act 395/2002 Coll. on archives and registers and on the amendment of certain acts.

Processing time

For the purposes of 1 and 2, personal data are processed until the selection process is fully concluded by the employer for a specific offer and the selection of a specific employee.

For the purposes of point 3, the data shall be processed until the expiry of the limitation period for private law claims, i.e. for a maximum period of 4 years from the end of the selection process and, if any legal claims proceedings have been initiated, then until the final conclusion of all proceedings and the recovery of all related benefits.

For the purposes of point 4, the processing period shall be determined by the retention period of the record, resulting from the law or the registry regulations, as a general rule 5 years.

Categories of processors or other recipients of data:

The PERSONALITY Group provides personal data of applicants and candidates to third parties, which are natural or legal persons or institutions established in the European Union that seek or recruit employees or workers for vacancies or similar positions (hereinafter referred to as the “Employer”). The employer is an independent operator within the meaning of the Regulation.

In addition, the PERSONALITY Group provides personal data of applicants and candidates to intermediaries who provide the PERSONALITY Group with services and activities related to the processing of personal data, in particular:

External personnel and contractors: natural or legal persons established in the EU who provide the PERSONALITY Group with work or services related to its core business where personal data is or may be provided or processed, in particular external consultants and selection process coordinators, lecturers, other persons coordinating the selection process or processing the results of the selection process for the PERSONALITY Group.

Accounting, tax and legal advisors: natural or legal persons established in the EU who provide accounting, tax or legal advisory services to the PERSONALITY Group.

IT services and IT platforms: natural and legal persons established in the EU who are authors, operators or administrators of electronic platforms or social networks through which PERSONALITY communicates with employers, applicants or candidates, conducts online seminars, online interviews or transmits or stores information are the recipients of applicants’ or candidates’ personal data. These are the contractual intermediaries of the PERSONALITY Group, which are:

Affected persons: Affected persons for this case are persons who have responded electronically, by telephone, in person, by letter, or otherwise to the PERSONALITY Group’s invitation or opportunity to include to the database job candidates, i.e. persons who may be sent information about job offers and who may also be contacted as candidates for non-specified positions and whose data may be provided to non-specified employers looking for employees or workers and who have given their voluntary consent to such processing (hereinafter referred to as “Candidates“).

What data we process, on what legal basis, for what purpose and for how long.

Scope of personal data: The PERSONALITY Group processes candidates’ personal data to the extent that it is provided in the contact form or ascertained in a personal or telephone interview or ascertained from publicly available sources by the PERSONALITY Group after a candidate has expressed an interest in being included in the candidate database, generally within the scope of name, surname, title, date of birth, address, email, telephone number, professional history, language skills, education, salary expectations, as well as the data contained in the CV and other documents you have provided to us and the data contained in the records of interviews you have had with the PERSONALITY Group and data from publicly available data sources (in particular social networks, public speeches).

Purposes of processing:

  1. Maintaining a database of job candidates, including the ability to share their personal data with unspecified clients of the PERSONALITY Group and to contact a candidate if they are a suitable candidate for a position with an unspecified candidate

  2. Asserting, defending and proving legal claims of the PERSONALITY Group and employers related to the recruitment process of a job candidate or services provided by the PERSONALITY Group to employers.

  3. Archiving, scientific research or statistical purposes.

Legal basis

The legal basis for the processing of candidates’ personal data for purpose 1 is the consent of the candidate within the meaning of Article 6 (1) (a) Regulation.

For purpose 2, the legal basis is Article 6 (1) f) of the Regulation, i.e. the existence of a legitimate interest of the PERSONALITY Group and/or the employer in asserting, defending and proving legal claims of the PERSONALITY Group and/or the employers related to the recruitment process of the job applicant or the services provided by the PERSONALITY Group to the employer.

For purpose 3, the legal basis in accordance with Article 6(1)(c) is the fulfilment of the legal obligation of the controller, arising in particular from Act 395/2002 Coll. on archives and registers and on the amendment of certain acts.

Processing time

For purpose 1, personal data are processed for the period specified in the consent, generally 3 years from the date of consent or until the consent is withdrawn, if sooner.

For the purposes of point 2, the data shall be processed until the expiry of the limitation period for private law claims, i.e. for a maximum period of 4 years from the end of the selection procedure in which the candidate’s data were provided, and, if legal proceedings have been initiated, then until the final conclusion of all proceedings and the recovery of all related benefits.

For the purposes of point 4, the processing period shall be determined by the retention period of the record, imposed by law or by the register, as a general rule 5 years from the end of the calendar year in which the data were obtained.

Categories of processors or other recipients of data:

The PERSONALITY Group provides personal data of applicants and employees to third parties, which are natural or legal persons or institutions established in the European Union that seek or recruit employees or workers for vacancies or similar positions (hereinafter referred to as the “Employer”). What data we process, on what legal basis, for what purpose and for how long.

If you are responding to an opportunity for a paid or free webinar, seminar, training or other educational event organized by the PERSONALITY Group or requesting an electronic publication, please fill out the contact form with the following personal information: title, first name, last name, email, phone number, profession, employer.

We will use this personal data for the following purposes:

  1. Event organisation: i.e. to allow you access in person or electronically to an event organised by the PERSONALITY group at the time and on the topic specified in the event form or offer;

  2. Consultation: if specified in the event offer, then also to provide you with a time-limited telephone or online consultation option on the webinar topic

  3. Delivery of requested content: if it is an electronic publication, so that we can deliver the requested publication to you.

  4. Asserting, defending and proving legal claims of the PERSONALITY Group related to the services provided by the PERSONALITY Group

  5. Tax and accounting purposes within the meaning of applicable law in respect of paid services/events to the extent of the data according to applicable law (identification, contact details and details of payment made or due)

  6. Archiving, scientific research or statistical purposes.

By submitting the completed form and agreeing to the terms and conditions of the event, you are entering into a contract with the PERSONALITY Group company organising the event for a free or paid (depending on the terms and conditions of the event) consultancy service, under which the Company has agreed to provide you with access to the event, or to provide you with a face-to-face consultation for a specified period of time after the event you have registered for, or to provide you with information and educational publications produced by the PERSONALITY Group.

Legal basis

The legal basis for the processing of the personal data of the event’s participants and candidates for the purposes of points 1-3 above is Article 6 (1) (b) of the Regulation, i.e. the fact that the processing is necessary to carry out pre-contractual measures at the request of the data subject (pre-contractual relationship between the applicant and the company of the PERSONALITY Group organising the event or providing the electronic content) .

For the purpose of point 4, the legal basis of Article 6 (1) f) of the Regulation, i.e. the PERSONALITY Group’s existing legitimate interest in asserting, defending and proving the PERSONALITY Group’s legal claims related to the services provided by the PERSONALITY Group to employers.

For purpose 5, the legal basis in accordance with Article 6 (1) c) Regulation of the fulfilment of the legal obligations of the operator, arising in particular from the law on accounting and tax regulations.

For purpose 6, the legal basis in accordance with Article 6 (1) c) Regulation of the fulfilment of the legal obligation of the operator, resulting in particular from Act 395/2002 Coll. on archives and registers and on the amendment of certain acts.

Processing time

For purposes 1, 2 and 3, personal data is processed for as long as necessary to fulfil the obligations and commitments related to the event, publication or consultation. In the case of a paid stated in the consent, generally 3 years from its granting or until the consent is revoked, if sooner.

For the purposes of point 4, the data shall be processed until the expiry of the limitation period for private law claims, i.e. for a maximum period of 4 years from the end of the event/offer at which the data were collected.

For the purposes of points 5 and 6, the period of processing shall be determined by law or by the retention period of the record imposed by law or by the register, as a general rule 5 years from the end of the calendar year in which the data were obtained.

  • Data Subjects:Data Subjects are natural persons who have given Personality Group their consent to be included in the register of subscribers to marketing communications.

    What data we process, legal basis, purposes and processing periods

    The categories of personal data provided by the data subject are: name and surname, e-mail, tel. number and, where applicable, address.

    The purpose is to send advertising and marketing communications, offers and information and important announcements about the PERSONALITY group. The processing period is the period for which the consent was given, if not specified therein, until the consent is withdrawn.

    The legal basis for sending advertising and marketing communications is the consent of the data subject within the meaning of Art. Article 6 (1) (a) Regulation.

    The processing period is specified in the consent, unless otherwise specified in addition to 5 years, but no longer than until the consent is withdrawn.

    Categories of processors1or other recipients of data

    The marketing database is operated with the assistance of an intermediary, The Rocket Science Group. We will disclose or make personal data available to public authorities if we are required to do so by law or if an incident has occurred. If necessary, we will disclose them to intermediaries and other recipients, which are mainly our legal, financial or accounting advisors for the purposes of risk assessment, representation in proceedings, or companies enforcing our claims.

    Withdrawal of consent:You may withdraw your consent at any time by sending an email to data@personalityhr.com by stating first name, surname and the text “I withdraw my consent for marketing purposes”. Withdrawal of consent does not affect the lawfulness of the processing of personal data prior to its withdrawal. Consent may also be withdrawn via a link that will be sent with the advertising and marketing communication.

  • Affected persons:Affected persons are natural persons who are contractual partners of the Personality Group or members of the statutory bodies of contractual partners and their contact persons.

    What data we process, legal basis, purposes and processing periods

    PurposePersonal data of contractual partners – natural persons as well as members of statutory bodies of contractual partners and their contact persons are processed for the following purposes:

    1. For the purposes of the preparation, conclusion and performance of a contract with a contractual partner

    2. compliance with legal obligations (in particular under the Accountancy Act, the Income Tax Act and the Archives Act and other legislation)

    3. Verification of the authorisation to act on behalf of the contractual partner and contacting the contractual partner regarding the personal data of persons who act on behalf of our contractual partners (statutory officers, senior employees) or are their contact persons under the contract for the purpose of fulfilling contractual obligations under our contracts, contacting the contractual partners and registering the documents on which their data is provided in accordance with the law.

    4. Where necessary to assert, prove or defend the legal claims of a PERSONALITY group company,

    The legal basis is

    1. Under Article 6 (1) (b) of the Regulation, i.e. the processing is necessary for the performance of a contract to which the data subject is a party or in order to carry out pre-contractual measures at the request of the data subject where the contractual partner is a natural person;

    2. Article Article 6 (1) (c) the legal obligation of the controller in cases where the law imposes an obligation to record or report the documents on which their personal data are included, in particular the Income Tax Act and the Accountancy Act

    3. Article Article 6 (1) f) Regulation of the Company’s legitimate interest in fulfilling its contractual and legal obligations or in contacting contractual partners through a contact person in respect of the personal data of persons who act on behalf of, or are contact persons for, the contractual partner or the contractual partner’s legal entity; and

    4. Article Article 6 (1) f) Regulation of the legitimate interest of the Company – asserting, proving and defending legal claims where the data is necessary for the purpose of asserting, defending and proving legal claims.

    Categories of personal data: we process personal data in the scope of title, first name, surname, function (position), telephone, email, or other contact data specified in the contract.

    Processing periodWe process personal data for the duration of the contract in which they are included or for the performance of which they are used. After termination of the contract, we still process this personal data during the limitation period for claims (generally 4 years) for the purpose of defending, proving and pursuing legal claims, or, if during such period proceedings have been commenced or are threatened in respect of the Company’s claims or obligations, until such proceedings have been concluded and all claims have been fully resolved. Personal data on documents and papers subject to compulsory registration or archiving shall continue to be retained for the duration of the period of archiving or registration.
